Ink&Gear – Terms of Service

1. Basic Provisions
(1) These Terms of Service apply to all contracts concluded with us, Ink&Gear Tattoo Supply Shop, via our online shop.
(2) Consumers, for the purposes of these Terms, are natural persons who act for purposes unrelated to their trade, business, or profession. Business customers are natural or legal persons or partnerships acting in a commercial or professional capacity.
(3) Any differing terms and conditions of the customer are not accepted unless agreed to in writing.
2. Conclusion of the Contract
(1) The subject of the contract is the sale of tattoo equipment and accessories.
(2) By placing products on our website, we make a binding offer to conclude a contract for these items.
(3) You may place products in the shopping cart, review, and correct your details before submitting your order via the “Order with obligation to pay” button. Submitting the order constitutes acceptance of our offer and concludes the contract.
(4) After placing the order, you will receive an automatic confirmation email containing your order details.
3. Payment
(1) We currently accept PayPal and bank transfer (prepayment).
(2) For bank transfer, you will receive our account details in the order confirmation. Goods will be shipped after payment is received.
(3) Any bank transfer fees, especially for international payments, are to be borne by the customer.
4. Shipping & Delivery
(1) Shipping within Germany is carried out by DHL or Hermes. For deliveries within the Stuttgart area (25 km radius), same-day delivery may be available.
(2) Free shipping is available within Germany for orders of €150 or more.
(3) Orders received by 13:00 are usually shipped the same day.
(4) Delivery times within Germany are typically 2–3 working days. Delivery times within the EU vary by country (approx. 3–7 working days).
(5) The risk of accidental loss passes to the customer upon delivery to the specified address.
5. Right of Withdrawal
Consumers have a statutory right of withdrawal of 14 days. Please see our Returns & Refunds Policy for details.
6. Retention of Title
The goods remain our property until full payment is received.
7. Warranty & Liability
(1) Statutory warranty rights apply.
(2) If products arrive damaged or incomplete, customers should notify us promptly (this does not affect statutory rights).
(3) Ink&Gear is not liable for delays caused by third-party logistics providers or force majeure.
8. Contract Language & Record Storage
(1) The contract language is English.
(2) Contract data is not permanently stored by us. Please print or save the order confirmation email.
9. Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The European Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr.
10. Applicable Law
German law applies. For consumers, this choice of law does not remove the protection of mandatory laws of your country of residence. The place of jurisdiction for business customers is Stuttgart, Germany.
